I understand that the approach to the question is, in summary: modifying the Pope is contingent, if they changed the conditions of the article would be changed again. I remain puzzled that much on whether and comprehensibility of this change, because it is full of “novators” who are already screaming from the rooftops that the death penalty now and forever is an implicit evil and the doctrine has changed, and here we return to the catchphrase “if the Pope intends this or that”, but we overlook this point.
One problem is that even still in 2018 a Catholic can be in the position of having to impose the death penalty: think of the military courts in theaters of war (Syria, to cite just one example,) where it is not always possible to ensure that a large delinquent end up in jail (I am clearly talking about killings in combat). There is no mention of this situation in the new Article: Thus a Catholic military will be between a rock and a hard place.
El Papa has deleted omnino the need from the death penalty. Rome has spoken, Because over ? But it was not, Pope gesuita, the great champion of discernment case ?
